Tourist or seasonal rental has become illegal in Paris provided that certain regulations are respected. What is the risk of offenders?
Since December 1, 2017, it is no longer legally possible to rent a Parisian real estate on tourist rental platforms such as Airbnb without having previously had the opportunity to authorization de la Marie de Paris and without having a registration or registration number. Although the laws are being enacted to govern the functioning of the Republic, a few malignant men are still having fun in transgressing it and are putting themselves on fire with the legislation. What are they risking? What do you risk by renting your apartment on Airbnb in Paris?
Heavy sanctions, but several cases of figures
While it is necessary to know how to rent your main or secondary residence on Airbnb, it is important to know what sanctions you are exposed to if you do so in the City of Paris without the approval of the Town Hall. Thus two cases of figures are observed:
Cases of the main residence
If you are the owner and the accommodation rented on Airbnb is your main residence you will risk in case of rent without authorization a fine of 450 euros.
Cases of secondary residence
Things are much more salty and severe in the case of secondary residences. Thus, the law provides for a fine of up to 50,000 euros to any offender who rents without authorization or registration his Parisian secondary residence on Airbnb. Not cumulative, this fine is subject only to one dwelling, and is subject to a maximum of 1,000 euros per day and per square metre until the situation is regularized.
This means that if you have 10 homes considered to be your secondary residences, if you rent them on Airbnb without permission from the Marie de Paris, you will be punished with a record fine of 500,000 euros. Added to this fierce sum of 1,000 euros per day per square metre. As much as giving up the idea of renting without authorization, and even if you thought you were concealing the rent on Airbnb from one or all of your secondary residences, the state has provided for a little gift for this particular case.
What do you risk in case of concealing your Paris accommodation?
In case of concealment or attempted concealment of premises subject to the authorization of the City Hall of Paris, you are exposed to a gargantue fine that can culminate in up to 80,000 euros and a criminal sentence of one year’s imprisonment. This heavy penalty also concerns cases of false statements, in accordance with article L651-3 of the Construction and Housing Code.
